ProofTap Record Viewing Terms

Applicable to persons who view a ProofTap record without downloading the ProofTap application

Effective Date: October 25, 2026  Version: 1.0

1. What You Are Reading

You have arrived at this page by scanning a tag, following a link, or searching the ProofTap web portal. The information displayed to you is a “Record.” A Record is a set of statements that a creator, brand owner, dealer, or other person submitted to ProofTap and that ProofTap wrote to a public blockchain.

ProofTap LLC (“ProofTap,” “we,” or “us”) operates the technology that records and displays Records. ProofTap did not create the Record you are viewing, did not inspect any item described in it, and does not know whether the statements in it are true.

2. Acceptance

These Record Viewing Terms govern your access to and use of the ProofTap scanner pages and web portal. By accessing, viewing, scanning, searching, or otherwise using those pages, you agree to these Terms. If you do not agree, do not use them.

These Terms are separate from the ProofTap Terms of Service, which govern persons who create Records or use the ProofTap application.

3. What a Record Does Not Establish

A Record is a statement by the person who submitted it. It is not a statement by ProofTap, and it is not evidence of any of the following:

  • That any item is authentic, genuine, original, or made by the party identified in the Record;

  • That any item is owned by, or was lawfully obtained by, any person offering it for sale;

  • That any item is in the condition described, or in any particular condition;

  • That any item has the age, model, specification, components, materials, country of origin, or history described;

  • That any item has any particular value, or that any price is fair;

  • That any chain of custody, provenance, or prior ownership is complete or accurate; or

  • That any legal title, intellectual property right, warranty, or other legal interest exists or has been transferred.

ProofTap does not verify, audit, investigate, authenticate, appraise, inspect, or confirm any information in a Record.

4. Tags Are Physical Objects

Where a Record is associated with a physical tag, including a near field communication tag, the following applies and is important.

Cryptographic authentication of a tag establishes only that the tag is genuine and has not been copied or emulated. It does not establish that the tag remains affixed to the item to which it was originally applied. Tags can be removed, damaged, destroyed, replaced, or attached to a different item, whether by accident or deliberately.

A Record therefore describes the tag and what was submitted about the item at the time the Record was created. It does not establish that the item now bearing the tag is that item.

5. Permanence and Errors

Information written to a public blockchain cannot be deleted or altered by ProofTap or by anyone else. A Record that was inaccurate when created remains visible permanently. ProofTap has no obligation to publish a corrective annotation to a Record, has no obligation to investigate or resolve any dispute about a Record, and any annotation is not an admission.

6. Status Indicators

A Record may display a status derived from events recorded on the blockchain, including whether a redemption credit associated with an item has been claimed. A status derived from a blockchain event reflects that event only. It is not a statement about the physical condition, age, prior use, or resale history of any item, and you should not read it as one.

7. Inspect Before You Rely

You are solely responsible for independently verifying any item before purchasing, selling, insuring, appraising, lending against, accepting as collateral, or otherwise relying upon it. A Record is one data point. It is not a substitute for physical inspection, professional appraisal, independent authentication, or the advice of a qualified professional.

If you are considering a transaction of significance, obtain independent verification.

8. No Professional Advice

Nothing displayed through the ProofTap scanner pages or web portal constitutes legal, financial, tax, accounting, insurance, investment, appraisal, regulatory, or other professional advice.

9. Disclaimer of Warranties

THE PROOFTAP SCANNER PAGES, WEB PORTAL, AND ALL RECORDS AND INFORMATION DISPLAYED THROUGH THEM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, PROOFTAP DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, OR AVAILABILITY.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PROOFTAP AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR ACCESS TO, USE OF, OR RELIANCE UPON ANY RECORD OR ANY INFORMATION DISPLAYED THROUGH THE SCANNER PAGES OR WEB PORTAL.

IN NO EVENT SHALL PROOFTAP’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF THE SCANNER PAGES OR WEB PORTAL EXCEED ONE HUNDRED DOLLARS ($100.00).

These limitations do not apply to liability arising from ProofTap’s fraud, intentional misconduct, or gross negligence, or to any liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

These limitations apply regardless of whether liability is asserted in contract, tort, warranty, statute, or any other theory, and survive any determination that a limited remedy failed of its essential purpose.

11. Michigan Law and Dispute Resolution

These Terms, and any dispute arising out of or relating to them or to your use of the ProofTap scanner pages or web portal, are governed by the laws of the State of Michigan, without regard to conflict of law principles.

Before filing any claim, you agree to send written notice of the dispute to ProofTap at legal@prooftap.io and to allow thirty (30) days for the parties to attempt to resolve it informally.

Any claim not resolved informally shall be brought exclusively in the state courts located in Wayne County, Michigan, or in the United States District Court for the Eastern District of Michigan, and you consent to the personal jurisdiction of those courts and waive any objection to venue there.

To the extent permitted by law, you and ProofTap each waive any right to a trial by jury and agree that any claim will be brought in an individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding.

12. Intellectual Property

ProofTap, the ProofTap name and logo, the scanner pages, the web portal, and their design, software, and content are protected by applicable intellectual property laws. Nothing in these Terms grants you any license or ownership interest except the limited right to view Records as the pages are intended to be used. You may not scrape, index, mirror, bulk extract, or systematically collect data from the scanner pages or web portal except through an interface ProofTap expressly makes available for that purpose.

13. Privacy

ProofTap’s collection and use of information in connection with the scanner pages and web portal is described in the ProofTap Privacy Policy at https://www.prooftap.io/privacy-policy, which is incorporated by reference.

14. Changes

ProofTap may revise these Terms. Revised Terms will be posted with a new effective date and version number and apply to access occurring after that date.
